Artificial intelligence and the extrajudicial recognition of social security rights: The role of Brazil's Attorney General's Office in enhancing access to justice

Abstract

This study examines how artificial intelligence (AI) can support the extrajudicial and consensual resolution of disputes involving social security rights, thereby enhancing access to justice. It focuses on the role of Brazil’s Attorney General’s Office (Advocacia-Geral da União — AGU), particularly within the institutional framework established following the enactment of Law No. 13,140 of 26 June 2015. The study asks under what conditions AI-assisted screening of social security disputes may contribute to their consensual resolution and how the AGU may operate within this emerging institutional framework. A qualitative approach is adopted, combining a structured review of the literature with documentary analysis of the applicable legal framework and interinstitutional agreements, with particular attention to the PACIFICA pilot project conducted jointly by the AGU and the Federal Public Defender’s Office (DPU). The findings indicate that AI-assisted screening has the potential to identify disputes suitable for consensual resolution at an earlier stage, reduce unnecessary judicialization, and facilitate the recognition of social security rights. However, this potential depends on institutional safeguards concerning legality, equality, data protection, transparency, human oversight, accountability, and accessibility for digitally vulnerable groups. The analysis further suggests that AI should operate as a decision-support mechanism rather than as a substitute for human legal judgment. The PACIFICA initiative illustrates an emerging model of interinstitutional cooperation in which technological tools may complement consensual mechanisms and contribute to a more responsive approach to access to justice.
